General Motors is hoping that the US Supreme Court will help it DODGE Billions is injury claims

 

 General Motors’ efforts to dodge hundreds of lawsuits related to a potentially fatal ignition-switch flaw in millions of its older sedans. After receiving a stinging defeat in a federal appellate court this past summer, the automaker is now making a Hail Mary pass to the U.S. Supreme Court to try to convince judges that it has reincarnated into a seven-year-old car company free of liabilities from its previous life.

 

With potentially billions of dollars’ worth of personal and financial injury claims at stake, the Detroit automaker’s lawyers argue that allowing these lawsuits to go through would undermine an important aspect of corporate bankruptcy: giving assurance to the buyers of troubled companies that they aren’t also buying a whole bunch of unexpected legal headaches.
But in GM’s case there was no outside buyer. It essentially bought itself (with taxpayer money) in the wake of the mortgage-lending crisis that tipped the nation into recession and steered the American auto industry into a ditch.

 

GM is arguing that it became a new company on July 10, 2009, the day a federal court approved the sale of assets owned by General Motors Corporation to General Motors Company.

With the blessing of a federal judge, GM initiated in 2009 a so-called 363 Sale, named after a code in corporate bankruptcy that has a “free and clear” doctrine that absolves buyers legal liabilities.

Mark Roe, a Harvard Law School professor who specializes in corporate bankruptcy, says GM’s use of the 363 Sale process doesn’t conform to the reason why the doctrine exists.

“The GM sale was not a true third-party sale,” Roe told Salon. “It was General Motors selling to a reorganized version of itself. The factories were the same, the employees were the same. There isn’t the same reason to protect a third-party buyer.”

The liabilities GM is trying to dodge pertain to a faulty ignition switch in 2.6 million of its older sedans linked to at least 124 deaths and at least 275 injuries, some of them severe. The switch can slip out of place while the vehicle is in motion, shutting off the engine and cutting power to steering, brakes and airbag systems. GM has already paid out about $2 billion in criminal and civil claims since the flaw was made public more than two years ago, but since the defect includes cars manufactured as far back as 2000, many of the injuries occurred prior to GM’s 2009 reorganization.

Last year, U.S. Bankruptcy Judge Robert Gerber — the same judge who oversaw the company’s 2009 bankruptcy — ruled in favor of GM on the “free and clear” doctrine. But in July, a three-judge panel at the 2nd U.S. Circuit Court of Appeals in New York overturned Gerber’s decision, saying the people injured by this ignition switch flaw deserve a chance to have their day in court based on the constitutional right to due process.

 

 The U.S. Supreme Court isn’t expected to respond to GM’s petition, which was sent on Tuesday, until sometime next year.
“This case presents exceptionally important questions, and the Second Circuit’s answers were exceptionally wrong,” GM’s lawyers said in the petition obtained by Reuters.

Lawyers representing these plaintiffs argue that their clients don’t lose their constitutional right to due process simply because GM deployed a code in the bankruptcy law, and the 2nd U.S. Circuit Court of Appeals agrees. 

GM argues that top executives at the company weren’t aware of the flaw until January 2014, when newly appointed CEO Mary Barra, a lifetime GM employee, was filled in on the issue. But the appeals court ruled in July that because some mid-level managers in the company had been aware of the problem for years, GM should have disclosed this during its 2009 bankruptcy proceedings, in accordance to the law.

 

Last year, GM initiated its own internal claims processing, in which it did accept claims from customers who were injured prior to 2009, but the company has stood firm against allowing any of them to pursue their cases in court. Now GM will wait and see if the U.S. Supreme Court agrees.

Obama Stole $2.6 BILLION From US Military Veterans To Give To Syrian Refugees

obama's most recent act of betrayal came when the Veterans Administration (VA) appeared before Congress and informed them that they were short $2,600,000,000 in their budget because that money was taken by obama and placed in obama's pet project, the Syrian refugee program.

 The Secretary of Veteran Affairs, Robert McDonald, told Congress that if they are not provided an additional $2.6 billion, they will be forced to deny veterans the care they have rightly earned.

 

Since 2008, the VA has been so underfunded, they are forced to deny US Veterans doctor appointments to mental health services, even a suicidal help line. Now, obama is trying to rob US Veterans  by removing funding to the tune of $2.6 billion dollars.  All so that he can resettle anti-American Syrian refugees who hate America. 

Immediately following that, the obama’s administration sent an additional $4.5 billion to help rebuild Syrian mosques and homes. I like to see obama spend one red cent to rebuild Christian Churches, which have been looted and burned by murderous muslims in the middle east.  Just to put salt in the wound, the kenyan, sent and additional $419 million to Syria for “humanitarian aid.”

 

FACT:  1 in 8 adults who are homelessness nationally is a US Veteran.  That breaks down to 47,725 almost 12 percent of the nation’s 436,921 homeless adults. At present, there are 31,505 homeless veterans, of which, 17,000 are starving without any help or aid from obama's Veterans Administration (VA).

A STEALTH bill https://www.congress.gov/bill/114th-congress/house-bill/4919 purported to help those with developmental disabilities would allow government agencies to locate people with tracking devices, which has some concerned the measure gives the federal government too much authority and power.

The legislation would permit the Justice Department to award grants to law enforcement agencies and non-profits for training and tracking devices to find individuals with autism or seniors with Alzheimer’s who have wandered away.


The bill has garnered the support of Democrats who say it would promote public safety and address the critical need of being able to locate these individuals.
However, some are concerned the measure goes too far. The bill’s original language authorized the Attorney General to insert tracking chips into individuals involuntarily.

“It is almost too absurd to believe that it is true, but the House Judiciary Committee is considering H.R. 4919 that would allow for the Attorney General to authorize tracking chips to be inserted AGAINST the WILL of the INDIVIDUAL. Once the government has decided that , FOR ANY REASON, that you are some how disabled you WILL BE chipped with a geo-location device.

According to a staffer who is familiar with the legislation, the language in the bill has been changed to ensure that tracking devices are not invasive or permanent, and would be voluntary.   That is until the bill is later amended and then it WILL BE mandatory that an individual will be chipped against their will.

The government would also be prevented from making a database. The attorney general would still be able to decide who could receive these tracking devices and would have access to the data. Did you just see that?  The government is going to be prevented from making a database...then in the very next sentence...the government would decide who would have access to the database. 
The whole point of putting a chip into someone would be useless if there as no database actually tracking said individual. 

“The new language calls for ‘non-invasive and non-permanent types of tracking devices,'” said Robert Romano, senior editor of Americans for Limited Government. “But that is still not good enough, because once the bill is LAW it can be AMENDED at any time. 

This bill is something the globalists have been wanting since the advent of the computer age.   The Rockefeller institute said that chipping everyone on the planet is one of their stated goals.  Lets face it no matter how well-intentioned this program is, having it overseen by the government is just asking for it to be abused.  There is no sane reason that the attorney general or any other government employee should be electronically tracking people as if they were cattle.

The H.R. 4919 bill is a devastating and egregious attack on civil liberties. Once this bill or any other like it becomes law it is only a matter of time before it is amended and then mandatory.  The Globalists HATE freedom and seek to crush it at every turn. A bill such as this, and others like it represent a diabolical overreach of the federal government. Referring to the goals of transforming the U.S. and global power structure, the paper states that because of the American Public's slant toward ideas of democracy and freedom, "this process of transformation is likely to be a long one, absent some catastrophic and catalyzing event - like a new Pearl Harbor."

 

PNAC members, and signers to its policy documents, include: Dick Cheney, Donald Rumsfeld, Paul Wofowitz, Jeb Bush, Richard Perle, John Bolton, Scooter Libby, Elliot Abrams, Richard Armitage, William Bennet, William Kristol, and Zalmy Khalilzad.

All men with their hands deep in the private defense, oil, and multi-national corporate industries poised to make vast sums of money and secure huge tracts of power and influence if PNAC policy evolved into U.S. Government policy. But military lawyers stepped in at the time and "stopped the unit from sharing the information with the FBI.

Why would high-level Pentagon officials not want information regarding terrorist suspects and details of their hijacking plot to be shared with the FBI?

 For his efforts to bring the disturbing news of Able Danger to light, Lt. Colonel Shaffer, a 23-year decorated veteran, was fired, publicly humiliated, stripped of his pension, and had a legal gag order placed on his right to speak out to the public and Congress.

Professor Jones' meticulous research explains why no other steel frame building, in the history of the world, has ever suffered a total collapse anywhere on the planet before or after 9/11 due to fire.

Never FORGET that Building 7 was NOT hit by an aircraft). Jones specifically references the fire at the Windsor Building in Madrid, Spain in February of 2005, which did not result in total structural collapse. And while significantly more severe than the fires of Building 7, which burned for only a few hours on only a few floors, the Windsor Building flames did not bring the building down. 

 

 The damage from the fire did produce a partial collapse, and this collapse behaved exactly in line with the laws of physics and nature. Part of the building fell in an isolated collapse into the street below, leaving a huge, gaping wound in the middle of the high-rise with exposed rebar and debris hanging hundreds of feet into the air. The inferno did not produce a symmetrical, straight down, box-like, virtual free-fall total collapse witnessed in the fall of Building 7. Strategically planted, well-timed explosive devices are what weaken steel symmetrically and create coordinated downward implosions. Not random fires scattered throughout a building.

Another, and perhaps stronger, piece of evidence for controlled demolition of Building 7 is the speed at which the structure fell. It was a 576-foot tall building, and a conservative estimate of available video evidence shows that it fell in 6.5 seconds. A marble, with nothing but wind resistance in its path, would fall to the ground from the same height in roughly 6 seconds. Somehow, the top of this building fell to the ground in a perfectly symmetrical downward trajectory, with 47 floors of steel, concrete, and thousands of tons of upright standing debris in its path providing huge amounts of vertical resistance, at virtually free-fall speed.
